Frustrated Long Island Rail Road riders have filed a lawsuit accusing the railroad of failing to keep commuters safe and comfortable following repeated delays and equipment breakdowns.
The class-action suit was filed Saturday on behalf of LIRR riders against the rail system and the MTA.
"The gist of this lawsuit is that the railroad is not providing safe conditions and not providing sanitary conditions," says attorney Paul Liggeri, who filed the suit along with two plaintiffs.
Liggeri says the problems have plagued the LIRR for years, but says the tipping point were the massive delays on the system last month. Those disruptions were caused by a number of equipment problems on the Amtrak-owned tracks at Penn Station.
"The MTA can try to push blame, but the bottom line is that as a customer and as an attorney, when I purchase my monthly ticket, I purchase it from the MTA and I expect a certain level of service," Liggeri says.
The suit comes as the MTA is warning of delays and disruptions this summer while Amtrak makes repairs at Penn Station.
News 12 reached out to the MTA for comment on the lawsuit, but a spokesman says the agency does not comment on pending litigation.
