He allegedly admitted to police that he had a few drinks before crashing the boat.

The 25-year-old is expected to appear back in court on Thursday.
Police say Jack Benjamin was operating a boat in the Great South Bay when it hit a jetty at the end of Browns River Road in Sayville on Monday.
One passenger was tossed from the boat and never resurfaced. Rescue crews spent Monday searching for the missing person and say that person was not wearing a lifejacket.
Benjamin and another passenger were treated for injuries and released. Three other people were not hurt.
This was the second boater to go missing over the weekend.
Police say Christopher Calma went overboard in Northport Harbor on Saturday and never resurfaced.
A search continues for both.
