The driver charged in the deadly crash at a Deer Park nail salon has been indicted on several charges, including second-degree murder.
Steven Schwally plead not guilty to 28 felonies, including four counts of second-degree murder, and dozens of other charges.
The prosecution said, on the day of the crash, Schwally bought two bottles of liquor at Stant’s Liquors. The store is located in the same mini strip mall as Hawaii Nail and Spa in Deer Park.
The Suffolk County district attorney said this type of purchase was a typical occurrence for Schwally.
According to the district attorney, Schwally’s blood alcohol level was .17, which is more than double the legal limit.
He is accused of driving 78 miles per hour, one second before impact.
The prosecution also said Schwally showed no remorse for the victims at the crash scene and did not ask about the victims.
Several family members and victims were in the courtroom, including the 12-year-old girl, who was seen on crutches.
Suffolk County DA Ray Tierney said, “This case is serious. He’s charged with four counts of murder in the second degree, punishable up to 25 years to life in prison. This case has had a devastating impact on our community."
Schwally has a prior DWI conviction.
The judge remanded Schwally without bail and suspended his driver's license. He is due in court again on August 29.
