The Second U.S. Circuit Court of Appeals struck down an Oyster Bay Town law Tuesday that banned day laborer solicitation on a four-block section in the town.
The 2009 law was put in place after officials said the day laborer gatherings caused dangerous conditions.
The decision says the workers have a First Amendment right to be there.
Town Supervisor Joe Saladino says the town will be appealing the federal court decision. He claims many of the workers are in the country illegally and his job, he says, is to protect his residents.
"We understand the need to protect the safety and integrity of our communities," he told News 12.
