A conviction has been thrown out for a Suffolk woman found guilty of causing the death of her unborn baby.
Jennifer Jorgensen, of Miller Place, was found guilty for the death of her unborn daughter after a 2008 crash.
In that same crash, Jorgenseon had been found not guilty of driving under the influence and causing the death of a couple in another car.
The state Court of Appeals ruled Thursday that the law did not intend to hold a pregnant woman responsible for harmful conduct on their unborn fetus, unless it is intentional.
Jorgensen had been sentenced to three to nine years in prison for the unborn child's death.
