Charges against the man accused of driving drunk and fatally hitting a Suffolk police officer were upgraded to aggravated DWI Tuesday.
Police say Jose Borbon, 23, was driving drunk early Sunday morning when he slammed into 2nd Precinct Officer Glen Ciano's cruiser at around 4:15 a.m. The cruiser burst into flames, burning it beyond recognition with the 45-year-old officer trapped inside.
Lab results show Borbon?s blood alcohol level was .19 at the time of the crash, prosecutors say. That?s more than twice the legal limit. Levels of more than .18 are enough for an upgraded charge of aggravated DWI. Prosecutors say Borbon could have been even more intoxicated, since the test was administered almost three and a half hours after the crash.
Police say Borbon, of Plainview, was arrested just one month ago for drunken driving and has a criminal history that includes resisting arrest, three license suspensions and five auto accidents.
Borbon?s bail was increased from $75,000 to $500,000 because of the upgraded charge. Investigators say they?re also looking into possibly filing homicide charges against Borbon. He will be back in court March 25.
