Charge upgraded to 2nd-degree murder in DWI crash

A man accused of driving the wrong way on a highway and causing a fatal crash pleaded not guilty to second-degree murder. An indictment was unsealed Monday in Central Islip for Christopher O'Brien.

A man accused of driving the wrong way on a highway and causing a fatal crash pleaded not guilty to second-degree murder.
An indictment was unsealed Monday in Central Islip for Christopher O'Brien. Authorities said O'Brien's blood-alcohol concentration at the scene was 2 1/2 times the legal limit and that he had cocaine in his system.
O'Brien, who was initially charged with driving while intoxicated, allegedly drove the wrong way on Sunrise Highway and hit a vehicle head-on in Yaphank on Dec. 23, killing 57-year-old Thomas D'Eletto, of Aquebogue.
State Supreme Court Justice Fernando Camacho ordered O'Brien to be held without bail. If convicted, he could face up to 41 years in prison.
