A lawsuit has been filed against Nassau County police after a Hempstead man claims he was wrongly assaulted and arrested.

Tyrone Phifer says it happened nearly three years ago as he was waiting for a ride home from his doctor’s office in Baldwin. He says police were searching for a man named LeRoy and he continuously told officers that he was not who they were searching for.

Phifer was charged with obstruction of governmental administration. The charges were dropped after 10 ½ months.

Police tell News 12 that they cannot comment on pending litigation.

Phifer and his attorney are seeking at least $5 million in damages.
