The state’s education commissioner says Massapequa schools cannot enforce a new policy banning transgender students from using bathrooms and locker rooms that align with their gender identities.

The ruling comes after the NYCLU appealed earlier this month.

The Massapequa School Board adopted the resolution in September.

State law says transgender students have the right to use facilities that correspond with their gender identity.

The Massapequa School board says the district will continue to offer a gender-neutral locker room and bathroom option to students more comfortable using such a space.
