Prosecutors say a man who has been charged in a fatal crash was driving faster than 100 mph before the collision.

Officials say 23-year-old Duke Obule slammed into a taxi in Franklin Square back in April, killing a 47-year-old cab driver from Elmont.

Obule pleaded not guilty Monday to charges including manslaughter and reckless endangerment.

He was originally charged with DWI, but that charge was thrown out after a toxicology report registered at less than .01 percent. Those results conflicted with a Breathalyzer test done on the scene that indicated he was double the legal alcohol limit.

Obule's attorney says new information from a passenger in Obule's BMW may prove his innocence.

"A witness may have testified in the grand jury that Re. Obule was not speeding and that the taxi cab made an illegal U-turn in front of him," says the attorney, Jason Russo.
