(11/21/06) RIVERHEAD ? Suffolk prosecutors say they have identified the triggerman in a murder that left a Holbrook teen dead behind the wheel of his Jeep.
A grand jury indicted three teens Tuesday for the murder. According to Suffolk District Attorney Thomas Spota, 18-year-old Brian Rivera fired the shot that killed 18-year-old Thomas Herzberg during a vehicle chase along Patchogue-Holbrook Road on October 24. Spota says another individual in the car, 18-year-old Russell Cronin, fired two shots before passing the unlicensed .357 to Rivera. Spota claims the chain of events stemmed from the attempted robbery of Herzberg?s passenger, who had intended to purchase drugs from Rivera.
Rivera, Cronin and Michael Weed are all being held without bail. Weed is accused of driving the Trailblazer during the chase with Herzberg. A fourth individual, Robert Latham, is charged with attempted robbery for allegedly driving a second vehicle that gave chase to Herzberg?s Jeep.
