Steven Schwally’s trial is continuing in Riverhead without Schwally present.

His attorney Christopher Cassar told News 12 that he had a “pretty serious heart attack” last week and remains in the hospital.

Cassar said Schwally chose to waive his appearance at his trial.

Asked if there’s a chance he’ll appear at any more of the trial, Cassar said, “I don’t think so.”

An SCPD officer who placed Schwally under arrest testified Tuesday.
