A judge will decide the fate of a rottweiler that attacked a 65-year-old man in East Hampton two weeks ago.

The dog attacked Richard Appel as he walked up Springs Fireplace Road to pick up his car at a repair shop. Appel needed more than 100 stitches in his leg after the 85-pound animal latched on to his calf.

Animal Control officials say this is the fourth person the dog has attacked since 1998. They say no action has been taken against the animal before because state law says that the victim must file a complaint. A young child previously filed a complaint after being bitten, but the victim's parents did not sign off on it. The dog's owner is due in court Wednesday.
