A judge dismissed a Town of Brookhaven lawsuit against PSEG Monday.

Officials say that the lawsuit from July 2017 called on the company to remove 211 steel utility poles that line County Road 51 from Eastport to Riverside.

The lawsuit was thrown out because it was filed after the poles were installed. The judge said that the removal of them would cause undue hardship on the utility.

Residents say that they want the Town of Brookhaven to appeal the judge's decision.

"They don't match the look of this town, and they don't begin to approach anything we want in this town," says Pete Kassebaum, an Eastport resident.

They say that PSEG pushed the project through without proper notification or an environmental impact study.

"It was sneaky. The job seemed to happen overnight. It was faster than any job I had ever seen," says Stephanie Turano, a representative from the Eastport Green Project.

PSEG Long Island tells News 12 that it is pleased with the judge’s decision.

News 12 reached out to the Town of Brookhaven for comment, but has not received a response.
