Gyms plan class action lawsuit against governor's decision to delay reopening
Hundreds of gyms say they're committed to filing a class action lawsuit after Gov. Andrew Cuomo decided that gyms would not be included in Phase 4 of New York's reopening plan.
SC Fit owner Charles Cassara says at least 300 other gym owners from across the state are committed to being part of the lawsuit and thousands have shown interest.
Howard Popkin, with the Popkin-Brogna Jujitsu Center in West Hempstead, is considering joining the lawsuit. He says they have a safety plan ready that includes social distancing with kids and instructors at least 8 feet apart and no contact.
Small business owners told News 12 they just want the same chance as every other business that's been allowed to reopen in the phase they were put in.
The class action lawsuit is expected to be filed next week.
