A Guatemalan man who is accused of selling a William Floyd Middle School student THC gummies that led to the hospitalization of 12 students has been apprehended trying to flee to Canada after being released without bail.

Wilmer Castillo Garcia was arrested by Canada Border Services Agency on Oct. 4 and placed into ICE custody following his release without bail, said Suffolk County District Attorney Ray Tierney.

The 22-year-old was previously indicted for criminal sale of a controlled substance for allegedly selling narcotics to an undercover officer. He was additionally charged with endangering the welfare of a child stemming from the William Floyd School incident.

Prosecutors say the investigation started when a dozen middle school students were brought to Peconic Bay Hospital after getting sick from eating gummies with THC, a compound in cannabis.

Law enforcement tracked the gummies to an Instagram account called "7k_teddy," which prosecutors say traced back to Garcia.

After the student's hospitalization, Castillo allegedly sold cocaine and marijuana to an undercover officer twice.

Since his charges are considered non-bail eligible, he was released on his own recognizance.

He has since been brought back to Suffolk County and is being held at the Suffolk County Correctional Facility.

He is expected back in court May 19 and faces up to nine years in prison.
