The Justice Department will not seek the death penalty for an alleged MS-13 gang leader and his brother.

Alexi and Jairo Saenz are facing criminal charges for allegedly killing teenagers Nisa Mickens and Kayla Cueva in Brentwood. They are accused of murdering five other victims.

Their trial is set to begin in March.

It is possible that Alexi could face the death penalty in an alleged eighth murder.

Federal prosecutors want the Department of Justice to make the decision by the end of the month.
