Four months after a former NYPD officer was charged with vehicular manslaughter in the death of her coworker, a grand jury upgraded the charges Monday.
A grand jury charged Danielle Baymack with manslaughter in the second degree, which contends an extra level of recklessness existed in addition to being intoxicated. In September, the 22-year-old was driving with her friend and fellow rookie officer Marlene Rivera on Sunrise Highway in Wantagh when the car crashed, killing Rivera. Prosecutors say Baymack was going over 50 miles per hour, while the speed limit was 45, and had a blood alcohol content of .11, which is above the legal limit.
According to Baymack's attorney, the charges were upgraded based on testimony from a reconstruction expert. He says the defense did not have access to the evidence used by that expert.
If convicted, Baymack faces up to 15 years behind bars. Her next court appearance is scheduled for February 9.
