A Yonkers man accused of threatening to kill police officers and Mayor Mike Spano will not face federal prosecution at this time under a deferred prosecution agreement.

Ridon Kola, 35, was arrested in 2023 in connection with the alleged threats.

During part of the time since his arrest, Kola was declared mentally incompetent and was treated at a psychiatric facility.

Following an investigation, the U.S. Attorney's Office agreed to defer prosecution for one year as long as Kola complies with a series of conditions.

Those conditions include staying off social media and having no contact with Yonkers police unless he needs help during a first responder emergency.

Kola and his attorney agreed to the conditions.

If Kola violates the agreement, federal prosecutors could move forward with the case.

If he follows all conditions for the full year, prosecutors say there will be no further prosecution.
