The New York State Department of State says eight complaints have been filed against Gallery Furniture in Medford.

Excited to see furniture in his new home in Seaford, Gregory Scolieri says the two couches he bought in January from Gallery Furniture in Medford still have not arrived.

"Now it's October, we've gone through a back and forth with the credit card company, with Gallery Furniture, and the end result is they're not delivering the furniture, they're not giving our money back," he said.

Scolieri contacted News 12 after seeing other customers had similar problems with Gallery Furniture.

"We wanted a place to sit and instead we're out $6,000 and a lot of time spent getting nowhere," he said.

News 12 has uncovered 8 complaints filed with New York's Division of Consumer Protection.

The Department of State told News 12 that four of the complaints against Gallery Furniture have to do with items not being delivered. The other complaints include damaged merchandise, incomplete order, and the wrong product arriving.

News 12 has also learned from court documents Gallery Furniture is in foreclosure, and in a lawsuit against owner Richard Kogel, a judge ruled in favor of a company that sued, claiming his businesses defaulted on a loan.

Scolieri has also filed a complaint with Suffolk County Consumer Affairs.

In a statement, Richard Kogel says:

"We fully recognize how frustrating delays can be for our customers, significant factory production delays have impacted special-order furniture. We are not simply waiting for the situation to resolve itself — customers are given the option to reselect from our in-stock merchandise."
