Riverhead property owner mulls suit against Shop & Stop due to noise

Residents of a Riverhead retirement community say they are dealing with excessive noise from a neighboring supermarket.

Residents at a Riverhead retirement community say they are dealing with excessive noise from a neighboring supermarket.
The Glenwood Village senior community residents say they have had enough of the noise coming from the Stop & Shop supermarket, which is just feet from their homes.
They say trucks disturb them at all hours of the day and night.
Glenwood Village property owner Brian Stark says he wants Stop & Shop to put up a sound barrier to prevent the noise from reaching the homes of his residents.
"If you want to be a good neighbor, they should come to me what do you really need what's going to lower the noise," says Stark.
Riverhead Town Supervisor Laura Jens-Smith says they have taken appropriate action.
"We issued them several violations and taken them to court in the violations that they have," she says.
Jens-Smith says the store has conducted a noise study and is working on a proposal to fix the noise issues.
While some want the town to file a lawsuit against the grocer, Jens-Smith says it's a better idea to work with Stop & Shop without litigation.
"It puts a burden on the tax payers when we're trying to work out a resolution that will be best for everybody," she says.
However, Stark says he may take legal action of his own.
"You try not to go to court because every time you pick up the phone and call an attorney it costs you money. I'm pretty much in the edge right now," he says.
Town Supervisor Jens-Smith tells News 12 she hopes to have a solidified plan from Stop & Shop within 30 days.
A Stop & Shop spokesperson told News 12 in a statement: "We're continuing to work with the community and are committed to finding a resolution that will reduce noise levels for our neighbors. We have engaged an engineering firm to develop and review plans for sound mitigation, which have been presented to the town of Riverhead for review."
