The village of Floral Park is being sued over a village code that bans door-to-door soliciting.
Attorney Jeremy Fielding represents Aptive Environmental – a Utah-based pest control company that claims the code is bad for business and violates its constitutional rights. He claims Aptive gets 99.9 percent of its business through door-to-door solicitation.
"Town ordinances that have restrictions on solicitations, especially bans, prevent us from being able to create [long-term] relationships and materially affect our business," says Fielding.
The village attorney says they don't comment on pending litigation.
According to court documents, village officials did agree to a temporary injunction last week, allowing the company to solicit door-to-door for now.
Both sides are due back in court on Oct. 4.
