Thomas Valva's mother denied request to keep CPS from visiting her home

The NYPD officer accused of killing his son and his fiancee were in family court Friday, where they faced off against the boy's mother in an ongoing custody battle.

The NYPD officer accused of killing his son and his fiancee were in family court Friday, where they faced off against the boy's mother in an ongoing custody battle.
Wearing a pin with her son Thomas' picture on it, Justyna Zubko-Valva made another appearance in Suffolk Family Court.
"We're never going to forget Tommy, he's always going to be in our hearts and minds," says Zubko-Valva.
Michael Valva and his fiancee Angela Pollina are both charged with murder in the hypothermia death of 8-year-old Thomas after police say he was forced to sleep in the freezing garage of the couple's Center Moriches home.
"What Michael did to Tommy, to my kids, and the years of abuse towards me cannot be forgotten," says Zubko-Valva.
During Friday's court appearance, Zubko-Valva petitioned the judge to stop Child Protective Services from visiting her home, where she's caring for two of her children. She told the judge, "CPS completely failed my children and they should not be involved in my life or my children's lives."
The judge denied that request, explaining that case workers are there for the sake of her boys, saying, "I'm not keeping it there to check up on you. I'm keeping it there to make sure I have accurate information on the children."
The judge says he will consider Zubko-Valva's request at her next appearance April 7.
Meanwhile, Pollina and her two ex-husbands also appeared in custody cases involving their daughters.
