The Supreme Court declined to hear an appeal on an overturned curfew at the East Hampton Airport.
Residents like Claudia McCarthy, of Sagaponack, say the rule would have helped prevent noise pollution at night during the summer beach season.
"Sunday nights and Friday nights are always the worst, and the helicopters are the worst," McCarthy says. "They make the most noise, and they fly the lowest."
The airport has gotten busier over time, McCarthy says.
The town had passed a curfew banning flights between 11 p.m. and 7 a.m. during the summer, but a group called the Friends of the East Hampton Airport successfully sued to block it.
The Supreme Court ultimately declined to hear the town's appeal.
"We're disappointed," says East Hampton Supervisor Larry Cantwell. "We have no right at the moment to adopt any restrictions at the East Hampton Airport, and that's what's of most concern to us."
He says he plans to seek help from the Federal Aviation Administration and Congress.
News 12 reached out to the Friends of the East Hampton Airport, the groups lawyer and companies that fly into the airport but did not immediately hear back.
