Suffolk DA hopes to upgrade charges against man accused in hit-and-run

Kadir was arraigned on a charge of leaving the scene that resulted in injury. Prosecutors want to upgrade that charge to leaving the scene of an accident resulting in death.

A 74-year-old woman who was run down and left critically injured last month by a hit-and-run driver may receive stiffer charges since the incident ended up resulting in her death.
Suffolk County District Attorney Tim Sini says they are seeking to upgrade charges against a 78-year-old man who left the scene of an accident that left a 74-year-old woman critically injured.
The incident occurred in Bay Shore on Feb. 10. Mary “Marie” Barbato died 10 days later from her injuries.
Suffolk police arrested Edward Kadir days after the crash. Authorities say Kadir turned himself in hours after police released a picture of the vehicle they believed hit Barbato and didn't stop.
On Tuesday, Kadir was arraigned on a charge of leaving the scene that resulted in injury. Prosecutors want to upgrade that charge to leaving the scene of an accident resulting in death.
Kadir was released on his own recognizance after his arraignment and had to surrender his passport.
John Barbato, the victim’s brother says the loss of his sister has been hard on his family.
"I want him to do some jail time or be punished for what he did,” says Barbato.
