A judge has ruled that police and the Nassau district attorney did not provide enough probably cause to arrest an oncologist accused of forcibly touching a female patient.
The judge also found that no other investigatory work was done after the interview with Dr. Dwight DeRisi's accuser.
DeRisi's attorney wants the case thrown out.
The district attorney's office says it will file a motion to re-argue the case.
