An assistant fire chief in Garden City Park is accused of threatening to kill his wife.

Court records show Matthew Flood, 38, was arrested Wednesday night and was charged with criminal mischief for allegedly breaking his wife's cellphone, the television and threatening to kill her. 

Flood's wife, Angela Alday, told News 12 about the scene inside the home. 

"My daughter was at the door, and my son was upstairs with the window open, and he pulled up and he said he was going to kill me, he was going to  [expletive]  murder me," she said. 

Flood's attorney says he believes his client is the victim and that Alday's motivation is to embarrass her husband because she's bitter he has a new girlfriend. 

Flood was released without having to post bail and signed a "do not harass" order. Alday's attorney says a family court judge also issued a stay away order of protection, meaning Flood cannot go to the house.

Flood is also disputing that the couple is legally married in New York state.
