Charges dismissed against two suspects in Fusco murder

All charges were dismissed Thursday against two men who served 17 years in prison for the rape and murder of a Lynbrook teen in 1984.

John Restivo and Dennis Halstead, along with John Kogut, were convicted in 1985 of raping and murdering Theresa Fusco. All three were released in 2003 when new technology showed their DNA did not match evidence at the scene. Kogut, the only suspect who confessed to the rape and murder, was found not guilty at his retrial last week.

Despite the judges decision that the physical evidence does not link the defendants to the crime, the Fusco family remains certain of the their involvement. Thomas Fusco, Theresas father, says the evidence still points to the three men and that the family is heartbroken by the verdict not to retry Restivo and Halstead.
