(AP) - An appeals court has ruled that Richard Ravitch can keep serving as New York's lieutenant governor during a legal fight over his appointment - but he can't preside over the state Senate.
Thursday's Appellate Division ruling leaves Ravitch in place at least until an Aug. 18 hearing on the dispute over the appointment.
The Senate is not currently in session but a special session has been called for next week.
Democratic Gov. David Paterson tapped Ravitch earlier this month to break up a monthlong Senate leadership logjam.
Senate Republicans say the appointment violates the state constitution. Paterson's lawyers say the state Public Officers Law allowed him to fill the post until the next election.
The ruling came after arguments earlier Thursday before a midlevel appellate panel in Brooklyn.
