The Nassau County cop who was allegedly drunk when he shot a cab driver in 2011 is facing departmental charges.
Officer Anthony DiLeonardo was off duty when he shot unarmed cabbie Thomas Moroughan in Huntington in 2011.
Nassau police will be holding a departmental hearing on the incident on Feb. 10, according to Newsday. DiLeonardo could be fired.
DiLeonardo admitted to Suffolk investigators that he drank before the shooting.
Moroughan was shot in the arm and chest, but survived.
William Petrillo, Moroughan's attorney, tells News 12 that his client prefers criminal charges are not brought against DiLeonardo because he doesn't want to be involved in a trial.
Moroughan filed a $30 million lawsuit against DiLeonardo, both Nassau and Suffolk counties and others, but the case is still pending.
