The attorney for the Massapequa man accused of faking his own death says he will be released from the hospital and will immediately surrender to State Park Police on Wednesday.
Raymond Roth, 47, supposedly disappeared from Jones Beach, but turned up down South five days later. Roth's attorney says he then checked himself into a psychiatric hospital on Long Island and is being held there involuntarily.
Roth is expected to face charges, although his attorney says he does not know what they will be.
Roth's 22-year-old son, Jonathan, was charged with conspiracy and insurance fraud after he told police his father went missing at Jones Beach.
