Former Suffolk Police Chief James Burke is appealing his prison sentence.
Court documents say Burke's appeal is based on the sentence, not on the conviction itself.
As News 12 has reported, Burke was sentenced to 46 months in prison after pleading guilty to violating the civil rights of a suspect and then conspiring to cover it up.
Burke could have been sentenced to up to 51 months behind bars.
