Police: Man drove drunk with 3 young kids in car
Police say a Stewart Manor man drove drunk with three young children in his car Saturday night and caused a three-vehicle crash.
Timothy McAleavey, 52, was involved in a crash at the intersection of Covert Avenue and 11th Street in New Hyde Park. Police who responded to the scene say McAleavey was unsteady on his feet and slurring his words.
Police say McAleavey had three children ages 1, 2 and 4 in his pickup truck at the time, along with his girlfriend, who is the children's mother. None of the children were in car seats.
No one was hurt.
The three children were released to their mother.
McAleavey was arrested at the scene and is facing felony charges under Leandra's Law. He faced a judge today in Hempstead, where he pleaded not guilty.
"I'm confident that when the district attorney of Nassau County takes a closer look at this case, it might find that it's not as serious as it appears," says Tom Monahan, McAleavey's attorney. When a News 12 Long Island reporter pointed out that there were three small children in his car, the lawyer replied, "But no one was hurt."
The assistant district attorney says McAleavey had a prior DWI 15 years ago.
McAleavey was released on $3,500 cash bail and is scheduled to reappear in court in two weeks.
