Lawsuit claims Suffolk OTB facility violates zoning laws

- A lawsuit has been filed against the Suffolk OTB by opponents of a plan to bring a gambling facility to Medford.
The OTB proposed the gaming site on a parcel of land off the Long Island Expressway's south service road.
Residents and civic organizations gathered at Brookhaven Town Hall Thursday to announce the filing of the lawsuit, which claims the proposal violates local zoning laws. They sounded off again Thursday night at a town board meeting.
Supervisor Ed Romaine says they are talking to the wrong elected officials. Romaine says that while the town board did pass a unanimous resolution opposing the casino, state law allows county OTB operators to construct a facility that is not bound by local town zoning laws. While Romaine showed little willingness to join the lawsuit filed by the citizens and civic associations, he did say the town is exploring other legal options as well.
In response to the lawsuit, Suffolk OTB President Phil Nolan told News 12, "At this time, I have not seen the legal papers. Once we receive them, we will review them and answer them in a timely manner."
