A Middle Island mother is being accused of purchasing heroin with her 4-year-son in the car.
Police say 34-year-old Giovanna Mirando parked her car on Hollo Drive in Holbrook Friday around 2:30 p.m. to allow her passenger to get out and meet with a drug dealer.
News 12 is told that 32-year-old Nicholas Verna bought heroin from Michael Scalia, then got back in the car and then split the drugs with Mirando.
Verna would not speak to News 12 while he was led out of the 3rd Precinct in Bay Shore.
Christopher Cassar, the defense attorney for Scalia, says his client was simply in the wrong place at the wrong time.
"My client did not sell heroin to anyone. This is a case of mistaken identity. He's totally innocent," said Cassar.
Mirando was charged with drug possession and endangering the welfare of a child. She was released on station house bail and will be arraigned at a later date.
Her 4-year-old son was released into the custody of a family member and child protective services have been notified.
Verna and Scalia were each charged with the sale and possession of a controlled substance.
