Theresa DiMilia sues Wendy's after Williston Park crash

WILLISTON PARK - A Long Island woman is suing Wendy's for a crash that nearly cost her a leg.

In early December, Theresa DiMilia and her daughter were pinned against Wendy's in Williston Park by a car that jumped the curb. Now, more than two months later, Dimilia is about to undergo her ninth surgery on her leg, which she says she begged doctors not to amputate. Her 11-year-old daughter Samantha suffered a broken leg, too.

DiMilia is filing a lawsuit not just against the driver, but against Wendy's, claiming the crash was easily avoidable. Her lawyer, Jeffrey Lisabeth, says six bollards were installed just days after the crash. If the bollards were there in the first place, DiMilia and Lisabeth claim the accident never would have happened.

Wendy's has not returned calls for comment.
