AMITYVILLE - A Suffolk contractor is in hot water Wednesday after being arrested in connection with a NY Rising scam.

Authorities say David Lizzol, of D&L Bathroom Remodeling, was contracted to do work to a house on Irving Avenue in Amityville. The home was damaged in Sandy and the owner wanted to raise the home 8 feet. Police say the homeowner, Larry Norton, used the $100,000 he was given from NY Rising to pay for the renovation. However, police say Lizzol took the money and gambled some of it away.

Lizzol has been charged with two counts of grand larceny. He faces five to 15 years if convicted.

Norton says he hired Lizzol to do other projects in addition to raising the house, but nothing got done. Norton says he is shocked that police think Lizzol gambled the money away, especially since he knows him personally and had him do work before.

Melissa Luckman, director of Touro Law's Disaster Relief Clinic, says cases like Norton's are on the rise. "Most of these contractors we have come across have filed for bankruptcy or they have no assets in their names," says Luckman.

Luckman says the best thing for people to do is file a complaint with Consumer Affairs, which Norton did and it led to an arrest.

Norton applied for a hardship claim with NY Rising and learned last month he was approved to receive additional funding.

There will be a Sandy recovery forum on this topic at the Touro Law Center next Monday.
