Cesar Hernandez-Rodas, 34, was hit and killed by a boat in Baldwin Bay.

FREEPORT - A Baldwin man has been charged with manslaughter after a passenger on his craft died, and police say he was drunk at the helm.

Police say Raymond Balboa took about a dozen of his wife's employees out on his 50-foot Sea Ray cabin cruiser, named La Vida Loca. Detectives say the 53-year-old was intoxicated while he was operating the vessel.

Balboa, a father of three, stopped the boat for a while to let his passengers jump into the water for a swim. A short time later, he told everyone to get back on and started the boat, but there was still one person in the water, according to police.

Detectives say 34-year-old Cesar Hernandez-Rodas was struck by the boat's propeller, killing him.

Witnesses Gene Levonson and his wife say they watched the ordeal unfold from their back patio. They say they saw a young man "jump off the boat when he was ready to leave."

Balboa's attorney says a witness saw Balboa walk around the boat twice before starting it to make sure everyone was out of the water.

Balboa pleaded not guilty in court today and is being held on $50,000 cash bail.
