WOODBURY - Charges have been dropped against a cab driver accused of assaulting two off-duty Nassau police officers.

Thomas Moroughan, 26, was shot in February by the two officers in Huntington Station during an argument. The officers say Moroughan tried to hit them with his taxi, and that's why they shot him.

Moroughan had said the officers were drunk and he did nothing wrong. Prosecutors have now decided to drop reckless endangerment and assault charges against Moroughan, citing a lack of evidence.

Moroughan's lawyer says he will file a civil suit.
