WOODBURY - Nassau County District Attorney Kathleen Rice is now calling for misdemeanor drug evidence to be retested because of concerns about cross-contamination amid an ongoing investigation of the county's now-defunct crime lab.

As News 12 Long Island has reported, Nassau's crime lab was shut down last year after reports of tainted evidence in DWI and drug cases. At the time, Rice ordered thousands of pieces of felony drug samples to be retested.

According to a district attorney's office spokesperson, this latest decision to retest drug samples from misdemeanor cases comes after new information came to light about the potential of cross-contamination.

Former Nassau County Bar Association President Marc Gann says he doubts many misdemeanor drug cases will be reopened because most of them are settled in a non-criminal manner.

A lab in Pennsylvania is being paid about $100,000 a month to retest all of the drug samples. County officials say the money comes from police forfeiture funds.
