CENTRAL ISLIP - A Middle Island man is facing upgraded charges in connection with a fatal crash in August.

Prosecutors say Kendell Owens had PCP, marijuana and cocaine in his system during a crash on Montauk Highway that killed Richard Garcia. The incident occurred as Owens was allegedly speeding away from police.

He was indicted Tuesday on manslaughter and vehicular manslaughter charges.

Just after his arrest, Owens, 31, admitted to reporters that he had PCP in his system while he was driving. His attorney Matthew Tuohy declined to comment further on the admission.

"I haven't had the chance to look at the lab reports as of yet. Certainly, I believe his emotions were high when it happened," says Tuohy.

Tuohy says his client has also expressed remorse for Garcia and his family.

Owens is being held on $2 million bond and could face up to 25 years in prison. He will be back in court Oct. 21.
