HEMPSTEAD - A judge has tossed a lawsuit brought by a Hempstead family against the town after cemetery employees exhumed and improperly buried a loved one. Family members say Edward Toppin died in 2009, but that his body was interred in another family's plot at Greenfield Cemetery. They claim Town of Hempstead grave workers then dug up the coffin and reburied it without the family's knowledge and blessing. After the family sued the town, the presiding judge threw out the case, saying town officials did not step over any legal boundaries in their actions. The Toppins say they plan to appeal the decision.
