BOHEMIA - A freelance journalist slapped the Suffolk County Police Department with a federal lawsuit today. Photographer Phil Datz was arrested last July during a police pursuit in Bohemia. A Suffolk sergeant told Datz he wasn't allowed to be on the scene, so Datz says he moved a block away and kept recording, at which point the sergeant arrested him. Though the charges against Datz were dropped, he's seeking compensatory damages and wants the police department to develop a policy to protect the First Amendment rights of the public and press. Police declined to comment on the lawsuit and said they typically don't discuss pending litigation.
