SEAFORD - A memo accidentally posted to the Nassau district attorney's website has given a new account in the shooting death of an ATF agent during a botched pharmacy robbery in Seaford. ATF agent John Capano was shot and killed outside Charlie's Family Pharmacy during a botched robbery attempt on New Year's Eve. Officials said a retired Nassau County lieutenant accidentally shot and killed Capano, not realizing who he was.

Now, a different account of the shooting has been made public that officials never wanted the public to know.Yesterday, the Nassau DA's office mistakenly posted an internal and confidential memo on its website, outlining a pharmacist's account of what happened that day.

The pharmacist told investigators Capano had been shot in the back. However, the autopsy report says he died from a gunshot wound to his chest. The pharmacist also claims that retired lieutenant Chris Geraghty shot first and then asked who the bad guy was.
