MASSAPEQUA - A Massapequa dad faced a judge in Hempstead this morning after allegedly driving high on drugs with his young children in the car.

According to police, Carlo Guercia was arrested after they spotted him swerving while leaving Marjorie Post Park on Unqua Road in Massapequa yesterday. Guercia had his 9-month-old and 3-year-old in the car at the time.

Witnesses say Guercia slapped the toddler in the face while in the park, then grabbed his neck and even left the infant unattended.

Police say Guercia failed a sobriety test and also had two Oxycodone pills in the car. A judge ordered him to stay away from his children. However, Guercia's relatives who were in court spoke out in his defense, saying he has never harmed his kids.

Guercia has been charged under Leandra's Law, as well as with possession of a controlled substance and endangering the welfare of a child. He is being held on $10,000 bail and is due back in court next week.
