Attorney fights for access to DA’s report, investigative notes in Jesse Friedman case

MINEOLA - Jesse Friedman’s attorney is fighting to gain access to the DA report and investigative notes pertaining to his client’s case.

Jesse Friedman and his father were convicted 25 years ago of sexually abusing boys at their Great Neck home while giving them computer lessons. Friedman served 13 years in prison. His father committed suicide in prison.

A federal court ruled the Friedmans could possibly have been innocent, citing overly aggressive questioning by detectives and psychologists used in the initial investigation. A 155-page report released by District Attorney Kathleen Rice this week upheld the conviction.

Ron Kuby was in court today asking for the entire report and 1,000 pages of investigative notes. Kuby has accused Rice of “whitewashing” Friedman’s attempt at exoneration.

One of the accusations in the report is that Friedman wrote a short story involving child pornography while in prison, something a court panel considered and found him not guilty of.

“Whether or not he was adjudicated not guilty, we have strong evidence supporting our assertion that he did write and/or possess that statement,” says Assistant District Attorney Robert Schwartz.

Kuby and Schwartz are expected back in court Aug. 5.
