Police say officer Brian Smales, of the highway patrol bureau, was conducting a follow-up investigation into a fatal accident that occurred earlier Sunday morning.

Officials say Smales was in his cruiser on the right shoulder of Sunrise Highway with his emergency lights on when Distefano rear-ended the vehicle. Smales' patrol car was outside of the lane of traffic when it was hit, investigators say.

Distefano is being held on $5,000 bail and is due back in court on March 11.
