A handicapped man says there is no wheelchair access to the bathrooms or the concession area at Tobay Beach.

Peter Hawkins, of Malverne, is fighting to make the bathroom and concession area at the beach handicapped-accessible.

The Town of Oyster Bay says it put up a turnstile and fence at the end of the bike path to safely keep bicyclists out of the parking lot. The bathroom and concession area are located on the other side of that fence.

A sign on the fence instructs handicapped people to call a phone number for access.

Hawkins says it's not only inconvenient, but discriminatory.

The town's park commissioner says he intends to look into the situation further and make necessary adjustments.
