The attorney for the estranged husband of Jennifer Dulos has filed to withdraw from his client's divorce case.
The motion lists Norm Pattis' work representing Fotis Dulos in the criminal case as a reason for the withdrawal. It also mentions that Dulos is represented by attorney Rich Rochlin, as well, in the divorce proceedings.
Jennifer Dulos' mother, Gloria Farber, filed for sole custody of the five Dulos children Tuesday. Last week, a judge granted Farber physical custody of the kids, who've been staying with her since Jennifer Dulos disappeared.
The new motion asks for legal custody, allowing Farber to make legal decisions concerning the children's health, education and welfare.
The filing comes a day after Fotis Dulos' attorneys withdrew a motion to halt the divorce and custody proceedings with Jennifer still missing.
Family law attorney Thomas Parrino speculates it could mean a change in strategy.
Farber is also suing Fotis Dulos in a separate civil case for about $2 million -- money she says her late husband loaned Fotis Dulos but he never repaid.
Farber wants to depose Fotis Dulos' girlfriend, Michelle Troconis, in the case
Troconis and Fotis Dulos are both facing criminal charges in connection to Jennifer Dulos' disappearance.
Troconis' defense attorney Andrew Bowman objected to the subpoena saying it violated her fifth amendment rights against self-incrimination. But Farber says she only wants to ask Troconis about the civil litigation and not her daughter's disappearance.
The judge Tuesday denied a request by Farber's attorney on an emergency hearing to depose Troconis.
